A Donnellson, Iowa man facing a serious misdemeanor of livestock neglect is expected to ask for a lesser charge.
Jeffery Graber, 55, was charged Jan. 8 after deputies removed several emaciated horses from his property.
A judge later ordered the horses returned to Graber due to a clerical error by the Lee County Sheriff's Office.
A motion filed by Graber's attorney says the neglect was unintentional.
Graber is asking to change the charge to a simple misdemeanor.
